Senator Thom Tillis, a member of the Senate Judiciary Committee, has publicly criticized U.S. Fourth Circuit Judge James Wynn's decision to rescind his retirement. Tillis described the move as "brazenly partisan" and unprecedented. According to Tillis, Judge Wynn's decision appears politically motivated due to Donald Trump's recent election as President.
Tillis stated, "Judge Wynn's brazenly partisan decision to rescind his retirement is an unprecedented move that demonstrates some judges are nothing more than politicians in robes." He further noted that this action undermines a bipartisan agreement within the U.S. Senate regarding the timing of confirming Wynn's replacement.
The senator suggested that the Senate Judiciary Committee should investigate what he views as an attempt by Judge Wynn to politicize the judicial retirement process. Tillis remarked, "The Senate Judiciary Committee should hold a hearing on his blatant attempt to turn the judicial retirement system into a partisan game, and he deserves the ethics complaints and recusal demands from the Department of Justice heading his way."
Adding context to his statement, Tillis pointed out that Judge Wynn had already celebrated his retirement nine months ago.
