"Ensuring that newborn babies receive medical care, regardless of the circumstances, should not be a divisive issue," stated Senator Tillis. "It is unconscionable that there are situations where health care professionals might not make every effort to save a life when the need arises. This commonsense legislation is crucial for protecting the lives of newborns, and I am committed to fighting for the life and well-being of babies who survive abortions."
The background of this legislative move traces back to 2002 when Congress passed the Born-Alive Infants Protection Act. This law recognized a newborn as a person from birth if they show any sign of life but did not include enforcement measures. The new act proposes clear expectations for care, hospital transfer requirements, mandatory reporting, private rights of action for mothers, and criminal penalties for healthcare professionals who fail to comply.
The Born-Alive Survivors Protection Act has received endorsements from various organizations including March for Life Action, Susan B. Anthony Pro-Life America, National Right to Life, and many others.
